Welcome to AeroWealth.

These Terms of Service govern your use of AeroWealth, including our website, applications, projections, tools and related services.

AeroWealth is operated by AERO DIGITAL VENTURES PTY LTD (ACN 699 359 889, ABN 59 699 359 889) ("AeroWealth", "we", "us" or "our").

By creating an account, starting a subscription or using the service, you agree to these Terms. If you do not agree, do not use AeroWealth.

1. The service

AeroWealth is a personal wealth forecasting and retirement planning tool. It allows you to model assets, liabilities, contributions, scenarios, retirement assumptions and other financial information to generate projections.

AeroWealth is a software tool for general information and educational purposes only. It is not a financial product, personal financial advice, tax advice, legal advice, credit advice or a substitute for advice from an appropriately licensed professional.

Any decisions you make using AeroWealth are your own responsibility. See our Financial Disclaimer for further details.

2. Eligibility

You must be at least 18 years old and able to enter into a legally binding contract to use AeroWealth. The service is designed for Australian users; if you use it from another country, you do so at your own risk and remain responsible for compliance with local laws.

3. Your account

You must provide accurate sign-up details and keep your credentials secure. You are responsible for all activity under your account. Notify us immediately at support@aerowealth.net if you suspect unauthorised access.

4. Subscriptions, billing and cancellation

AeroWealth may offer free and paid subscription plans.

Paid Pro subscriptions are billed in advance through Stripe at the price displayed at checkout. Unless otherwise stated, all prices are in Australian dollars.

At the effective date of these Terms, AERO DIGITAL VENTURES PTY LTD is not registered for GST. No GST is currently charged on subscription fees.

By starting a paid subscription, you authorise Stripe or our payment provider to charge your nominated payment method on a recurring basis until you cancel.

Your subscription automatically renews at the end of each billing period unless cancelled before the next renewal date.

You may cancel your subscription at any time through the Billing page. Cancellation takes effect at the end of the current billing period, and you will retain access to Pro features until that date.

Subscription fees are not refundable for unused portions of a billing period, except where a refund or other remedy is required by the Australian Consumer Law.

If a renewal payment fails, we may retry the payment, restrict access to Pro features, or downgrade your account to the Free plan until payment is successfully processed.

We may change subscription prices, Pro features or plan limits from time to time. We will provide at least 14 days' notice of a material change. Any price change will apply from your next billing period after the notice period.

If you do not agree with a price change, you may cancel your subscription before the new price takes effect.

5. Acceptable use

You agree not to:

Reverse engineer, scrape, or attempt to bypass access controls.
Upload content that is unlawful, infringing, defamatory, or that you do not have the right to upload.
Use the service to harm others, send spam, or to circumvent rate limits.
Resell, sublicense, or provide the service to third parties without our written consent.

6. Your data and content licence

You retain ownership of the financial data and scenarios you enter ("Your Content"). You grant AeroWealth a limited, non-exclusive, worldwide licence to host, process and display Your Content solely for the purpose of providing the service to you. We handle Your Content in line with our Privacy Policy.

7. Intellectual property

AeroWealth and its licensors own all rights in the software, projection engine, design system, brand, and documentation. We grant you a limited, revocable, non-transferable, non-exclusive licence to access and use the service for your personal financial planning, subject to these Terms.

8. Third-party services

AeroWealth relies on third-party providers including Stripe (for payments), our cloud backend provider (for hosting and database), and our transactional email provider. Your use of features powered by those providers is also subject to their terms. We are not responsible for outages, errors, or losses caused by third-party providers.

9. Beta and preview features

From time to time we may release features marked as "beta", "preview" or similar. Those features are provided "as is", may change or be removed without notice, and may produce inaccurate results.

10. Service availability

We aim for high availability but do not guarantee uninterrupted or error-free service. Features may change, be added, or be removed. We may perform maintenance that temporarily limits access.

11. Reliance on projections

All forecasts, retirement ages, withdrawal rates, investment balances, mortgage outcomes, financial independence milestones, target incomes and other outputs generated by AeroWealth are estimates only.

Actual outcomes may differ materially due to investment performance, inflation, interest rates, taxation, superannuation rules, legislative changes, personal circumstances, property values, fees, contribution changes and other factors.

AeroWealth does not guarantee investment returns, retirement outcomes, financial independence dates, tax outcomes or the accuracy of any projection.

You should obtain independent financial, tax, legal or other professional advice before making significant financial, superannuation, investment, borrowing or retirement decisions.

12. Indemnity

To the extent permitted by law, you agree to indemnify and hold harmless AeroWealth, its owners, operators, employees and affiliates from any claim, loss, liability, cost or expense (including legal fees) arising from your breach of these Terms, your misuse of the service, or content you submit to the service.

13. Limitation of liability

Nothing in these Terms excludes, restricts or modifies any rights or remedies you may have under the Australian Consumer Law or any other law that cannot lawfully be excluded.

To the maximum extent permitted by law, AeroWealth is provided on an "as available" basis.

We do not guarantee that the service will always be available, uninterrupted, error-free, secure or suitable for your particular circumstances.

To the maximum extent permitted by law, AERO DIGITAL VENTURES PTY LTD is not liable for indirect, incidental, special or consequential loss, including loss of profits, investment losses, lost opportunities, tax consequences or losses arising from reliance on projections generated by the service.

Where liability cannot be excluded but may lawfully be limited, our liability is limited, at our option, to re-supplying the service or refunding the subscription fees paid by you for the affected service.

14. Force majeure

We are not responsible for any delay or failure to perform our obligations caused by events beyond our reasonable control, including internet or telecommunications outages, cyber attacks, natural disasters, pandemics, third-party service failures, or acts of government.

15. Termination, account deletion and data retention

You may close your account at any time from the Settings page. We may suspend or terminate accounts that breach these Terms, that we reasonably suspect of fraudulent or unlawful activity, or that remain unpaid. On termination, your access ends and we delete your scenario data in line with our Privacy Policy. We may retain certain information after deletion where required by law, for fraud prevention, billing and tax records, dispute resolution, or other legitimate business purposes.

16. Changes to these Terms

We may update these Terms from time to time.

For material changes, we will provide notice by email, in-app notification or another reasonable method before the updated Terms take effect.

If you continue to use AeroWealth after the effective date of the updated Terms, you agree to the updated Terms. If you do not agree, you must stop using AeroWealth and cancel any active subscription.

17. Governing law

These Terms are governed by the laws of New South Wales, Australia. You and AeroWealth submit to the exclusive jurisdiction of the courts of New South Wales and the courts of appeal from them.

18. General

These Terms, together with the Privacy Policy and Financial Disclaimer, are the entire agreement between you and AeroWealth regarding the service. If any provision is found unenforceable, the remaining provisions continue in full force. Our failure to enforce a right is not a waiver of that right. You may not assign these Terms without our consent; we may assign them as part of a corporate transaction.
